Producer pEPR fees & invoice resubmissions follow up

A couple of weeks ago the internet was all abuzz with the news that due to a high number of resubmissions late in 2025, the total packaging tonnage was lower than expected. 

We published a news article at the time explaining how these lower tonnages had potentially led to a deficit of funds for Year 1 of the EPR scheme, and the impact this may have on producers’ costs (Notices of Liability). 

Today, 24 February 2026, PackUK have announced that this shortfall will be picked up by the UK Government for this year only, to help mitigate the increasing costs and uncertainty for producers, and to maintain stability during the formation years of the scheme. 

What this means for you 

PackUK have confirmed that there will be no change to the pre-published base fees for Year 1, and any producers who had previously completed a resubmission will receive an updated Notice of Liability (NoL) to reflect their final tonnages against these fees. The updated NoLs are planned to be sent to producers by the end of March. 

What’s next? 

This was the first year of the scheme, and a lot has happened in the last 12 months, but hopefully now that the 2025 compliance year is closed, we have closure on the Year 1 fees, and producers have made the necessary adjustments and resubmissions after the shock of their first NoL. We should have smoother sailing in Year 2 (2026/2027) and less variation in the Year 2 base fees between ‘confirmation’ after April and the end of the compliance year.
